You might recall that this past September Congress passed the Military Commissions Act of 2006, which Bush subsequently signed into law. This law:


  • made the President the sole judge of what acts are torture and what aren't
  • made the President the sole authority to choose whether or not to punish torturers
  • gave the President unlimited power to imprison people, regardless of citizenship- including American citizenship- indefinitely
  • denied people held as "unlawful enemy combatants" by the President habeas corpus, trial by jury and the protection of the Geneva Accords


In effect, this law allows George W. Bush, or any subsequent President, to torture at will with zero accountability.

All but a handful of Republicans in Congress voted for it- including famous anti-torture activist John McCain.

Well, an election has come and gone. On October 2 I posted a list of every Congressperson and Senator who voted for this law. Here's that list again. Names in bold are of people who will be back in the upcoming Congress. Names in italics have been replaced with members of the same party.

I wouldn't bet on the Military Commissions Act getting repealed anytime soon...

For those who don't want to count, only forty-seven of those who voted for this legislation are on their way out... and for fourteen of those, they were able to essentially pick their successor- they were followed by persons of the same political party into office.

That means only thirty-three people who endorse torture- five Senators and twenty-eight Representatives- were turned out at the polls. That still leaves a clear majority in both houses who favored this legislation.

Quit calling it anything but what it is: the Torture Act of 2006. The more people who openly call a spade a spade, the less likely they are to be able to make it fade into the woodwork. Language MATTERS in politics, and the Christianists have been using it to their own advantage for 20 years or more. It's time to fight back.

The thing is, people who actually want to look up the law will need to use the name the pols gave it- the Military Commissions Act. "Torture Act" is more accurate, but it's useless for getting any actual action, if such is possible.

It's a law, and as such, is under the scrutiny of the Supreme Court.

And you also gotta know it already has four votes minimum to uphold- Scalia, Thomas, Alito, Roberts.

I predict Kennedy will join the conservatives in a 5-4 decision upholding the Military Commissions Act as a wartime measure, in order to "defer to the legislative and executive branches."
