You might recall that this past September Congress passed the Military Commissions Act of 2006, which Bush subsequently signed into law. This law:


  • made the President the sole judge of what acts are torture and what aren't
  • made the President the sole authority to choose whether or not to punish torturers
  • gave the President unlimited power to imprison people, regardless of citizenship- including American citizenship- indefinitely
  • denied people held as "unlawful enemy combatants" by the President habeas corpus, trial by jury and the protection of the Geneva Accords


In effect, this law allows George W. Bush, or any subsequent President, to torture at will with zero accountability.

All but a handful of Republicans in Congress voted for it- including famous anti-torture activist John McCain.

Well, an election has come and gone. On October 2 I posted a list of every Congressperson and Senator who voted for this law. Here's that list again. Names in bold are of people who will be back in the upcoming Congress. Names in italics have been replaced with members of the same party.

And you also gotta know it already has four votes minimum to uphold- Scalia, Thomas, Alito, Roberts.

I predict Kennedy will join the conservatives in a 5-4 decision upholding the Military Commissions Act as a wartime measure, in order to "defer to the legislative and executive branches."
